Titus Builders provides construction and related services including, but not limited to:
- Custom residential home construction (2BHK, 3BHK, 4BHK)
- Villa and luxury residential construction
- Commercial building construction
- Civil and structural work (foundation, RCC, plumbing, electrical)
- Renovation and remodelling
- Architectural design and planning
- Interior design and finishing
- Project management
All services are subject to a separate written agreement or contract signed between Titus Builders and the client before commencement of any work.
Project Agreements & Contracts
Every project undertaken by Titus Builders is governed by a formal written contract. This contract will specify the scope of work, materials, timeline, payment schedule, and any other relevant terms agreed upon by both parties.
No verbal agreement, estimate, or discussion constitutes a binding contract. A project is considered formally accepted only when a signed agreement is in place and the agreed advance payment has been received.
Any changes to the scope of work after signing must be agreed upon in writing via a change order document before work on the modification begins. Scope changes may affect cost and timeline.
Payment Terms
Payment terms are outlined in your individual project contract. Generally, payments are milestone-based — linked to the completion of defined construction stages. The standard schedule is communicated in the quotation document.
Delayed payments may result in a temporary suspension of work. Titus Builders reserves the right to apply a late payment charge as specified in the contract. Continued non-payment may result in legal action in accordance with applicable Indian law.
All estimates and quotations provided are valid for 30 days from the date of issue unless otherwise stated.
Materials & Specifications
Titus Builders uses ISI-grade, certified materials sourced from reputable brands. The specific materials, brands, and specifications for your project will be listed in the project contract.
Any substitution of specified materials, whether at the client's request or due to unavailability, will be communicated in writing and agreed upon before proceeding. Substituted materials will be of equivalent or superior quality.
Client Responsibilities
To ensure smooth project execution, clients are expected to:
- Provide accurate land documents, approvals, and permits as required by local authorities
- Ensure site access for our team during agreed working hours
- Make payments on time as per the agreed milestone schedule
- Communicate any changes or concerns in writing in a timely manner
- Obtain all necessary statutory approvals (building permits, NOCs, etc.) unless explicitly delegated to Titus Builders in the contract
Titus Builders is not liable for delays caused by the client's failure to fulfil these responsibilities.
Warranties & Defect Liability
Titus Builders provides a structural defect liability period as specified in the project contract (typically one year from the date of handover for structural issues). During this period, any defects arising from poor workmanship or material failure will be rectified at no additional charge.
This warranty does not cover damage caused by natural disasters, misuse, unauthorised modifications, or wear and tear. Warranty claims must be raised in writing within the defect liability period.
Delays & Force Majeure
Titus Builders will make all reasonable efforts to complete projects within the agreed timeline. However, delays may occur due to circumstances beyond our control, including but not limited to adverse weather, material shortages, labour disputes, government directives, or natural disasters ("force majeure events").
In such cases, Titus Builders will notify the client promptly and the project timeline will be extended accordingly. No penalty will apply for delays caused by force majeure events.
Intellectual Property
All architectural drawings, design documents, plans, and related materials prepared by Titus Builders remain the intellectual property of Titus Builders until full payment has been received. Upon final payment, design documents for your specific project are transferred to you for your personal use.
Content on this website — including text, images, graphics, and branding — is the property of Titus Builders and may not be reproduced without prior written consent.
Limitation of Liability
To the maximum extent permitted by applicable Indian law, Titus Builders shall not be liable for any indirect, incidental, or consequential damages arising from the use of this website or from delays, interruptions, or defects in services beyond those directly caused by our negligence.
Our total liability in any matter shall not exceed the value of the project contract relevant to that matter.
Governing Law & Disputes
These Terms and Conditions are governed by the laws of India and the state of Kerala. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Thiruvananthapuram, Kerala.
We encourage clients to first attempt resolution through direct communication. If unresolved, disputes may be referred to arbitration as per the Arbitration and Conciliation Act, 1996, before formal legal proceedings.
Amendments
Titus Builders reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our website or services after changes constitutes acceptance of the revised terms.
